{"id":267,"date":"2025-10-20T15:37:15","date_gmt":"2025-10-20T15:37:15","guid":{"rendered":"https:\/\/amthaueryoyarzun.cl\/?p=267"},"modified":"2025-10-20T15:37:15","modified_gmt":"2025-10-20T15:37:15","slug":"que-es-la-negligencia-medica-y-cuando-existe-responsabilidad-legal","status":"publish","type":"post","link":"https:\/\/amthaueryoyarzun.cl\/index.php\/2025\/10\/20\/que-es-la-negligencia-medica-y-cuando-existe-responsabilidad-legal\/","title":{"rendered":"\u00bfQu\u00e9 es la Negligencia M\u00e9dica y Cu\u00e1ndo Existe Responsabilidad Legal?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">La negligencia m\u00e9dica se configura cuando un profesional o establecimiento de salud \u2014p\u00fablico o privado\u2014 act\u00faa con falta de cuidado, impericia o incumplimiento de los deberes propios de su profesi\u00f3n, provocando da\u00f1o f\u00edsico o psicol\u00f3gico a un paciente.<br>En t\u00e9rminos simples, ocurre cuando el paciente sufre un perjuicio que pudo evitarse si se hubieran seguido los protocolos m\u00e9dicos adecuados.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La responsabilidad nace solo cuando el da\u00f1o deriva de una conducta culposa o imprudente del m\u00e9dico o del centro asistencial, y puede dar lugar a indemnizaciones por perjuicios tanto materiales como morales.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-mediacion-obligatoria-el-paso-previo-a-demandar\">Mediaci\u00f3n Obligatoria: El Paso Previo a Demandar<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Antes de iniciar una demanda judicial por negligencia m\u00e9dica en Chile, la ley exige agotar un procedimiento previo: <strong>la mediaci\u00f3n obligatoria<\/strong>.<br>Este paso es requisito indispensable, sin el cual el tribunal no admitir\u00e1 la demanda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. Mediaci\u00f3n en el Sector P\u00fablico<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cuando la supuesta negligencia ocurre en un hospital, consultorio u otro establecimiento perteneciente al sistema p\u00fablico de salud, la mediaci\u00f3n debe realizarse ante el <strong>Consejo de Defensa del Estado (CDE)<\/strong>.<br>El procedimiento busca que las partes \u2014paciente y entidad p\u00fablica\u2014 lleguen a un acuerdo sin necesidad de juicio, lo que puede incluir una compensaci\u00f3n o una disculpa institucional.<br>Si la mediaci\u00f3n no prospera, se entrega un <strong>certificado de cierre<\/strong>, documento esencial para poder presentar la demanda ante los tribunales civiles.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. Mediaci\u00f3n en el Sector Privado<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En los casos que involucran cl\u00ednicas, centros m\u00e9dicos o profesionales particulares, la mediaci\u00f3n se realiza ante la <strong>Superintendencia de Salud<\/strong>.<br>Este procedimiento tambi\u00e9n es obligatorio y gratuito. Se lleva a cabo con un mediador acreditado que intenta acercar a las partes para alcanzar un acuerdo que repare el da\u00f1o sufrido por el paciente.<br>Si no hay entendimiento, la Superintendencia entrega un <strong>acta de t\u00e9rmino<\/strong>, la cual habilita para interponer la demanda civil correspondiente.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-acciones-legales-posteriores-indemnizacion-de-perjuicios\">Acciones Legales Posteriores: Indemnizaci\u00f3n de Perjuicios<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Una vez finalizada la mediaci\u00f3n sin acuerdo, el paciente o su familia pueden demandar judicialmente a los responsables para obtener una indemnizaci\u00f3n.<br>Las principales categor\u00edas de da\u00f1o que pueden reclamarse son:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Da\u00f1o Moral:<\/strong> Compensaci\u00f3n por el sufrimiento f\u00edsico y psicol\u00f3gico ocasionado por la negligencia.<\/li>\n\n\n\n<li><strong>Da\u00f1o Material:<\/strong> Reembolso de gastos m\u00e9dicos, tratamientos, medicamentos o p\u00e9rdida de ingresos laborales.<\/li>\n\n\n\n<li><strong>Da\u00f1o Emergente y Lucro Cesante:<\/strong> Cubre tanto los gastos directos como las ganancias que el paciente dej\u00f3 de percibir a causa del da\u00f1o.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">El monto de la indemnizaci\u00f3n depender\u00e1 de la gravedad del da\u00f1o, la evidencia m\u00e9dica y la acreditaci\u00f3n de la culpa del profesional o instituci\u00f3n.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-actua-a-tiempo-los-plazos-son-clave\">Act\u00faa a Tiempo: Los Plazos Son Clave<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Los plazos para iniciar la mediaci\u00f3n y posterior demanda son limitados.
